These Terms & Conditions (“Terms”) govern your use of distinctivetrading.io and any products, services, indicators, educational materials, coaching, live trading content, community access, or other services offered by Distinctive Trading, LLC (“Distinctive Trading,” “we,” “us,” or “our”).

By using our website, purchasing a product or service, creating an account, or accessing our content, you agree to these Terms.

1. Educational Purposes Only

All content and services provided by Distinctive Trading are for educational and informational purposes only.

Nothing provided through our website, indicators, classes, coaching, live trading sessions, Discord or other communities, social media, videos, messages, or other communications should be considered personalized financial, investment, tax, or legal advice.

Distinctive Trading does not make trading decisions for you or exercise control over your brokerage account. You are solely responsible for your own trading and investment decisions, including order entry, position sizing, risk management, and determining whether any trade or strategy is appropriate for you.

No relationship created through use of our services should be interpreted as a fiduciary relationship.

2. Trading Risk

 

Trading stocks, options, futures, and other financial instruments involves substantial risk and may result in the loss of some or all of your trading capital.

Leveraged products such as futures and options can produce losses rapidly. You should never trade with money you cannot afford to lose.

There is no guarantee that any strategy, indicator, methodology, market observation, or educational concept discussed by Distinctive Trading will produce profitable results.

Past performance is not necessarily indicative of future results.

 

3. Live Trading and Market Commentary

 

Live trading sessions, community discussions, Discord content, market commentary, trade discussions, charts, examples, and observations are intended to demonstrate how traders may analyze markets in real time.

They are not trade alerts, individualized recommendations, or instructions to enter or exit a particular position.

Market conditions can change quickly. A position discussed during a live session may change, be adjusted, or be closed before another user has an opportunity to act on the information.

You are responsible for independently evaluating any information before making a trading decision.

 

4. Indicators and Trading Tools

 

Indicators, scripts, software, charts, market tools, calculations, and other technology provided by Distinctive Trading are analytical tools only.

Indicators may generate inaccurate, delayed, incomplete, or misleading information due to market data issues, software errors, platform changes, connectivity problems, calculation methods, or other circumstances.

No indicator should be relied upon as the sole basis for a trading decision.

Unless otherwise stated, purchasing or receiving an indicator gives you a limited, personal, non-exclusive, non-transferable license to use it. Ownership of the underlying code, methodology, design, documentation, and intellectual property remains with Distinctive Trading.

You may not reproduce, distribute, publish, resell, sublicense, share, reverse engineer, modify for redistribution, or commercially exploit our indicators or proprietary materials without written permission.

 

5. Simulated, Hypothetical and Backtested Results

 

From time to time, Distinctive Trading may discuss hypothetical, simulated, reconstructed, or backtested trading results.

These results have inherent limitations and do not represent actual trading unless specifically identified as such. Hypothetical results may benefit from hindsight and may not fully account for real-world factors such as liquidity, slippage, commissions, execution delays, changing market conditions, emotional decision-making, or the ability to follow a trading strategy during periods of loss.

No representation is made that any account will achieve results similar to any hypothetical, simulated, backtested, or historical example presented.

 

6. Testimonials and Examples

 

Testimonials, customer comments, trading examples, and individual experiences appearing on our website or other Distinctive Trading materials reflect the experiences of the individuals involved.

They are not guarantees that another person will achieve the same or similar experience or trading results.

Trading results vary substantially based on experience, account size, risk tolerance, market conditions, execution, discipline, and many other factors.

 

7. Coaching and Educational Services

 

Coaching is intended to help users better understand markets, trading concepts, tools, methodologies, and trading processes.

Coaching does not include management of your account or responsibility for your trading decisions.

Any discussion of a specific security, option, futures contract, trade, or market situation during coaching is presented in an educational context. You remain responsible for determining whether and how to apply that information.

 

8. Payments, Subscriptions and Renewals

 

Prices and payment terms are displayed at the time of purchase.

Some services or memberships may be offered on a recurring subscription basis. When you purchase a recurring subscription, you authorize the applicable payment provider to charge the stated subscription amount at each renewal until you cancel.

Cancellation stops future renewals but does not normally provide a refund for an existing subscription period.

You are responsible for cancelling a recurring subscription before its next renewal date if you do not wish to continue the service.

 

9. Refunds

 

Unless a specific product or service states otherwise, purchases are final once digital access has been provided, an indicator or downloadable product has been delivered, community access has been activated, or a service has begun.

Payments are non-refundable except where otherwise expressly stated by Distinctive Trading or required by applicable law.

Additional cancellation or rescheduling terms may apply to booked coaching sessions or other scheduled services.

 

10. Accounts and Community Conduct

 

You are responsible for maintaining the security of your account and login credentials.

Paid access, membership credentials, indicators, course materials, or community access may not be shared with others unless expressly permitted.

We may suspend or terminate access for conduct including unauthorized sharing or redistribution of content, harassment, fraud, disruption of a community or service, attempts to circumvent access controls, or other material violations of these Terms.

Termination resulting from a violation of these Terms does not automatically entitle the user to a refund.

 

11. Intellectual Property

 

Unless otherwise stated, all Distinctive Trading content—including indicators, source code, trading methodologies, graphics, videos, classes, written materials, educational materials, branding, logos, website content, and proprietary concepts—is owned by or licensed to Distinctive Trading.

Your purchase of a product or service does not transfer ownership of that intellectual property.

Content may be used for your personal educational purposes only unless we provide written permission for another use.

 

12. Third-Party Services

 

Distinctive Trading may rely on or provide links to third-party platforms and services, including charting platforms, brokers, exchanges, market data providers, payment processors, Discord, social media platforms, and other technology providers.

We do not control these third parties and are not responsible for their availability, accuracy, security, policies, outages, changes, or actions.

References to third-party companies or products do not imply affiliation, sponsorship, or endorsement unless explicitly stated.

 

13. Availability and Changes

 

We may modify, update, replace, suspend, or discontinue products, indicators, content, features, communities, classes, schedules, or other services from time to time.

We do not guarantee that any particular product, indicator, community channel, instructor, feature, or service will remain available indefinitely.

We may also update these Terms when necessary. The effective date at the top of this page will identify the most recent version.

 

14. Disclaimer of Warranties

 

Our website, content, products, indicators, and services are provided on an “as is” and “as available” basis to the fullest extent permitted by law.

We make no guarantee that our services will be uninterrupted, error-free, continuously available, compatible with every trading platform, or suitable for any particular trading objective.

We make no guarantee regarding profitability, trading performance, investment results, or financial outcomes.

 

15. Limitation of Liability

 

To the fullest extent permitted by applicable law, Distinctive Trading, LLC and its owners, employees, contractors, instructors, and affiliates will not be liable for trading losses, investment losses, lost profits, lost opportunities, data loss, business interruption, or indirect, incidental, special, consequential, or punitive damages resulting from your use of or reliance upon our website, products, services, indicators, educational content, live trading content, or community discussions.

You acknowledge that all trading decisions are made at your own discretion and risk.

To the extent liability cannot legally be excluded, Distinctive Trading’s aggregate liability relating to a product or service will not exceed the amount you paid to Distinctive Trading for the specific product or service giving rise to the claim.

 

16. Indemnification

 

You agree to indemnify and hold harmless Distinctive Trading, LLC and its owners, employees, contractors, and affiliates from claims, liabilities, losses, or expenses arising from your misuse of our services, violation of these Terms, infringement of another person’s rights, or unlawful conduct.

 

17. Governing Law

 

These Terms are governed by the laws of the state in which Distinctive Trading, LLC maintains its principal place of business, without regard to conflict-of-law principles.

Any dispute that is not otherwise resolved between the parties will be brought in a court of competent jurisdiction serving that location, unless applicable law requires otherwise.

 

18. Severability

 

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

 

19. Entire Agreement

 

These Terms, together with our Privacy Policy, Refund Policy, and any product-specific terms presented at the time of purchase, constitute the agreement between you and Distinctive Trading regarding use of our website, products, and services.
